Coastside Fishing Club Files Opening Brief as Part of Its Appeal Against Unfavorable Ruling
Sacramento, CA – June 20, 2012 – With the recent adoption of marine protected areas in California’s northern region, a vast network of no-fishing zones along California’s coastal waters is now in place. However, the legal status surrounding how these no-fishing zones were established remains a question. Coastside Fishing Club, a member of the Partnership for Sustainable Oceans (PSO) which represents the recreational fishing and boating community, has announced that legal efforts against the Marine Life Protection Act (MLPA) process, which established the no-fishing zones, continues. Coastside recently filed an opening brief in its appeal of an October 2011, ruling that upheld the regulations created through the MLPA process.
“While anti-fishing groups have celebrated the adoption of MLPA regulations throughout the state, we remain confident that these regulations were enacted without legal authority,” said Coastside Fishing Club’s President Rick Ross. “We are hopeful that through this appeal, the serious flaws in the MLPA process will be recognized by the court and, subsequently, overturned.”
Coastside Fishing Club, along with United Anglers of Southern California and California citizen Robert Fletcher, filed a lawsuit in January 2011, against the California Fish and Game Commission to invalidate regulations established through the MLPA process. The lawsuit cites a lack of statutory authority for the California Fish and Game Commission to adopt the closure regulations. The Commission relies on a statute that was enacted as part of the Marine Managed Areas Improvement Act. This Act has certain prerequisites to regulatory action, which the Commission admittedly did not satisfy.
Despite this, a judge in the San Diego Superior Court ruled against Coastside Fishing Club in October 2011, upholding the MLPA regulations. After a careful review, Coastside concluded that the ruling is inconsistent with the mandates of the law as established by the legislature, and initiated the appeal process. A ruling from the appellate court is expected by year’s end.
“The legal effort against the MLPA is our best chance to stop these burdensome closures from continuing to negatively impact California’s fishing community,” said Ali Hussainy, president of BDOutdoors.com. “The best way for anglers to help fight for their fishing rights in California is to visit www.SaveCAFishing.org and make a contribution. All anglers need to stand together and fight for our right to fish before it’s too late.”
Along with the PSO, BDOutdoors launched www.SaveCAFishing.org to raise awareness of the legal challenge against the flawed MLPA process and to provide an opportunity for all anglers, boaters and anyone interested in fair legal process to contribute to the effort. Under the “Donate” section of the site, individuals can contribute $5.00 or more a month on a recurring basis, or make a one-time donation. All proceeds will directly support legal action to keep California’s healthy and abundant coastal waters open to recreational fishing.
Sixty-thousand fish, all a part of the fall brood and each about four inches long, were dumped from the truck, through a wide rubber hose and into a specially made holding pen that was about 54 feet long by 30 feet wide and 14 feet deep. When the operation was complete, the pen was pulled to a mooring between the inner and outer break of the harbor.
The delicate operation was quite a spectacle. A crowd gathered at the end of Johnson Pier to watch as the fish splashed into the pen and shimmered in the sun.
The work is a joint venture by the Coastside Fishing Club and the California Department of Fish and Game, and it is funded through private club donations and proceeds from the salmon stamp necessary to fish for Salmon in California waters.
Mark Gorelnik is a member of the fishing club’s board of directors. He said the project is intended to introduce the fish to saltwater while bypassing the hazards of the inland delta. Salmon populations had diminished greatly in recent years. Gorelnik credits the hatchery trucking program, in part, with bringing back salmon in large numbers. This year fishermen expect a banner year.

Paddled out of the Santa Cruz harbor Monday morning. Started trolling when we got to the buoy. Headed another 3 miles out to 180 feet of water and hooked up with a 30 inch salmon. Perfect conditions, no wind, glassy water, partly sunny. Tried to find where all the motor boats were headed, but they were too far out. Still, more than happy to have hooked up with salmon. Did 12 miles in total, but my buddy has a sail on his kayak and he towed me home when the breeze picked. Nice buddy!

One of the updates to the site today was the release of our new logo. While it retains the traditional colors and shape, the new logo sports some attitude.

Today, Coastside Fishing Club launched its own, one-of-kind live online VHF radio feed.
Starting with Half Moon Bay, Santa Cruz by end of week and other planned stations in the works, Coastside will bring live VHF traffic from recreational boats to its subscribed members. The Coastside network is planned to have coverage out to the tuna grounds.

In an effort to tighten security, the Coastside BOD has enacted a change to the forums registration process.
Moving forward, users will now be now required to fill in key fields in their profiles:
1) The name of our sport (this has always been a requirement during initial registration)
2) Your name
3) Your location
All new users are now required to fill in the above. For existing users, you have 30 days to make these changes and update your profiles. We will notify you after April 1st if those changes are not made and ask that you do please do so.
How do you do this?
For New Users: A window to enter required information will pop up for the three fields requiring entry.
Existing Users: Please go to the top right corner of the screen, select the [Settings] option. On the next screen, midway on the left side you will find under “My Settings”, an option to [Edit Profile]. Select and make the updates on the screen that comes up. If you entered the “our sport” question at initial registration, you may not see a field for this. Name and location will be the only ones available for entry. Update those.

We had talked about a Coastside fishing trip in April toLa Paz. I have had several Coastsiders asking about this at theSacramentoshow so I thought I would drop you a line. A good time in April, Moon phase and all would be April 18th thru the 22nd. This is a Wednesday thru Sunday deal, fishing 3 days, 2 people per room and boat. Pricing covers boat,license,hotel, breakfast on fishing days, lunch, water and soda on the boat, vacuumn packing and freezing, free use of our tackle(Avet reels/ugly sticks) and daily transportation to and from town. Dinners, bait and tips are extra
2012 Price for the package is $850.00. If we get more than 8 I’ll cut the price to $800 and throw in a full on pig luau on the beach for the last night.
Now flights. We handle those as well. Normally we fly our Northern California Customers to Los Cabos and then transport them toLa Pazvia 12 person vans. This is about a 2 hour drive each way. Normal van ride cost is $65 per person round trip. These are private vans so you can stop for Beer, etc.
I checked on direct flights today and they are around $530 SFO to Cabo on those specific dates. Flights are beginning to go up so the earlier we book the better the prices are.Alaskais the big carrier flying to and fromCSAto Los Cabos.
